Herbert was born in Hong Kong and received his primary and secondary education at St. Paul’s Co-educational College, Hong Kong. He read Law at the University College of the University of London and obtained the Bachelor of Laws degree with honours in 1973. He served his articles of clerkship in a city firm in London and qualified to practise as a solicitor in England in 1976. He was awarded the Master of Laws degree by the University of London in 1977.
Herbert joined an established Chinese firm on his return to Hong Kong and was admitted as a partner in 1980. He was a joint senior partner of the firm from 1994 until his departure in early 1999 to establish this Firm. He was appointed a Notary Public in 1990. He was admitted as a barrister and solicitor of the Supreme Court of Victoria in Australia in 1984, a barrister and solicitor of the Supreme Court of the Australian Capital Territory and a barrister of the High Court of Australia in 1990 and also an advocate and solicitor of the Supreme Court of Singapore in 1993. He is an Associate Member of the Australian Institute of Insurance and a China-Appointed Attesting Officer.
Herbert was the President of The Law Society of Hong Kong between 2000-2002 and is still actively participating in its affairs. In recognition of his contributions to Hong Kong SAR, he was appointed a Justice of the Peace in 2001 and awarded the Bronze Bauhinia Star in 2006. He was also made a Fellow of the Hong Kong Polytechnic University in 2009. He is also a member of the following public and educational organizations:
